These Terms and Conditions (“Terms”) govern your use of our mobile phlebotomy, DNA, and urine testing services (collectively, the “Services”). By using our Services, you agree to these Terms. If you do not agree to these Terms, please do not use our Services.
Services Provided
Waived Mobile Testing offers mobile phlebotomy, DNA, and urine testing services. Our services are designed to provide convenient, at-home testing options. Specific tests and procedures will be outlined during the appointment scheduling process.
Appointment Scheduling
2.1 Booking: Appointments can be scheduled via our website, mobile app, or by contacting our customer service team.
2.2 Cancellation and Rescheduling: You may reschedule your appointment up to 48 hours in advance without penalty. Cancellations or rescheduling requests made less than 24 hours before the appointment will incur a non-refundable fee.
Client Responsibilities
3.1 Accurate Information: You are responsible for providing accurate and complete information during the scheduling process, including any relevant medical history or conditions that might affect the testing.
3.2 Accessibility: Ensure that the testing location is accessible and that the procedure is performed in a suitable environment.
Fees and Payment
4.1 Charges: The cost of the Services will be communicated to you prior to booking. Payment is due at the time of booking the service.
4.2 Refunds: Refunds are not provided for services rendered.
Privacy and Confidentiality
5.1 Data Protection: We are committed to protecting your privacy. Your personal and medical information will be handled in accordance with our Privacy Policy and applicable data protection laws.
5.2 Confidentiality: Results and any personal data related to your tests will be kept confidential and only shared with you or authorized individuals as required by law.
Limitation of Liability
6.1 Service Accuracy: While we strive to provide accurate and reliable testing services, we do not guarantee the accuracy of the results. If you have concerns about your test results, please consult a healthcare professional.
6.2 Liability: Waived Mobile Testing is not liable for any indirect, incidental, or consequential damages arising from using our Services or any inaccuracies in test results.
Medical Emergencies
In the event of a medical emergency, you should seek immediate assistance from a qualified healthcare provider. Our Services are not intended to replace emergency medical care.
Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on our website and will become effective immediately upon posting. Your continued use of our Services constitutes acceptance of any revised Terms.
Governing Law
These Terms will be governed by and construed in accordance with the laws of the states of Texas and Idaho, without regard to its conflict of law principles.

Non-Refundable Affiliate Fees and Promotion Disclaimer
All affiliate fees paid to Waived Mobile Testing, L.L.C. are non-refundable under any circumstances. Additionally, Waived Mobile Testing, L.L.C. is not required or obligated to promote or facilitate sales for the partner’s business. While we may offer guidance and sales calls, Waived Mobile Testing, L.L.C. is not responsible for the success of any partner’s business. Any promotional efforts undertaken by Waived Mobile Testing, L.L.C. will be at its sole discretion.
Your Responsibilities:
12.1 By purchasing a Service, you agree to provide accurate biological samples as instructed in the Kits we provide. Obtaining a reliable test result depends on collecting a quality sample by diligently following the provided instructions. You affirm that any samples you provide to the Company are yours, or if provided on behalf of another person with legal authorization, that they belong to that person.
12.2 It is recommended that you seek independent legal advice regarding your rights to obtain and use biological samples from individuals other than yourself. You certify that you have legal possession of the samples provided to the Company.
12.3 You must be of legal age to enter a binding contract with the Company and not barred from receiving Services under applicable laws to use the Services and accept these Conditions.
12.4 You confirm that you are mentally sound and capable of understanding the nature and purpose of the Service you purchase.
12.5 You agree to comply with all relevant laws and regulations governing your access and use of the Site and the purchased Service.
12.6 You certify that you are not an insurance company or employer seeking information about an insured person or employee.
12.7 You acknowledge that information from the Service may be unexpected or emotionally impactful.
12.8 You understand and accept that you have no rights to any research or commercial products resulting from your sample submission and will not receive compensation for such products.
12.9 You warrant that you will not use the Service information, whether in whole or part, or combine it with other databases, for discriminatory or illegal purposes.
Account Creation, Customer Account, Passwords, and Security
(1) In order to access and download test results from the Service, you must create an account on the Site. By using the Site and Service, you agree to: (a) provide accurate, current, and complete registration information about yourself as prompted by the Site; and (b) keep your registration information updated. Failure to provide accurate and current information, or if there is reasonable suspicion of inaccurate or incomplete information, may result in the suspension or termination of your account by the Company, and may also lead to the refusal of any current or future use of the Service or the Site.
(2) You are the only authorized user of the account you create on the Site, and you are fully responsible for all activities conducted under your account. You may not permit others to use your account credentials, nor can you transfer or assign your account to another person or entity. If you suspect unauthorized access to your account, you must promptly notify us using the contact details provided at the end of these Terms. The Company is not liable for any losses, damages, liabilities, expenses, or fees incurred due to unauthorized use of your account, even if you have informed us of such unauthorized access. You acknowledge and agree that we may request information to confirm your identity to maintain the security of your account.
(3) Upon purchasing a Service, you may receive your test results via email. It is your responsibility to maintain the confidentiality of your test results. Allowing third parties access to your test results may result in liability, costs, or damages for which you are responsible. You agree to indemnify and hold the Company harmless against any claims or suits by third parties related to unauthorized access to your test results. Promptly notify the Company of any unauthorized use of your test results. The Company is not liable for any losses or damages resulting from your failure to comply with this provision.
